RCPD Arrest with Geary County Connection
Commissioners approve agreements with local health providers
Riley County Health Department Director Brenda Nickel presented three contract agreements to county commissioners Thursday morning with local healthcare partners.
The agreements are continuations of previous ones, and are with the Konza Prairie Community Health Center, Positive Connections — a community based HIV/AIDS service organization out of Topeka — and finally with the Kansas Department of Health and Environment for a Geary, Pottawatomie and Riley Counties Regional Public Health Preparedness Grant.
The new agreement with Konza Prairie Community Health Center will put more cash in the county’s pocket, too.
The agreement reflects an increase in annual rent for space at the health department in the amount of $11,796. Konza’s license agreement has been revised to reflect the increase in space utilization through
their expansion of primary medical services offered through the RCHD location.
Rent for Konza will increase from $1,925 per month to $2,908 on Aug. 1.
Commissioner Ben Wilson asked Nickel why Konza pays rent while that’s not a requirement for the space Positive Connections uses.
Nickel said it has to do with the revenue structures of both entities.
“Konza actually generates revenue through insurance, self-pay and private and public insurance,” she responded. “They have that built into their budget to be able to pay for space.
“Positive Connections is grant-funded and not a revenue generator. So, we choose just to have those services available. They provide benefits to clients who are HIV positive. It just makes sense to have Konza pay the rent verses those others. It’s a great question.”
In other items, Riley County IT/GIS Director Kevin Howser told commissioners additional cameras are being placed inside the courthouse.
“We did complete, or almost complete the process of adding the additional cameras at the courthouse requested by some of the judicial folks over there,” he said. “There were some dead areas that couldn’t be viewed, so we’ve almost completed the remedy of that issue.”
Murder Trial Begins in Riley County Court
A Kansas City man’s jury trial started Tuesday with jury selection taking up the entire morning and into the afternoon. Anthony Nichols is accused of murdering John Burroughs, a Manhattan Country Club employee, between the 6th and 7th of September 2013. Burroughs was found dead on his bathroom floor in his residence, a result of one gunshot wound to the face and eight stab wounds to his body. Nichols has already been convicted in a Geary County murder that happened just days after the murder of Burroughs.
During opening arguments, Nichols’ attorney claimed there is no evidence connecting Nichols with the crime scene, and a key witness in this trial is withholding vital information connected to this murder. According to the defense, the witness named Tina Love is the only witness connecting Nichols to the scene of the murder. Love has also reportedly been inconsistent with her side of the story over two years of interviews with law enforcement.
Several witnesses were called to the stand Tuesday, including law enforcement from both Riley County and Junction City. A testimony by Burroughs’ manager at the time, Dave Kelly, described Burroughs as a wonderful employee who always showed up to work on time.
This trial is expected to continue through Friday. KMAN will continue to report updates as this trial proceeds.
UPDATE: Murder Trial Draws to a Close
The Anthony Nichols Trial wrapped up Friday afternoon with a verdict. Riley County jurors found Nichols guilty of attempted murder.

The Anthony Nichols murder case is now in the hands of the jury, with closing arguments held Friday morning at the Riley County District Courthouse after the state amended the charge of murder in the 1st degree to attempted murder.
The state says there is plenty of evidence against the defendant, including matching fingerprints found on the gun in his Kansas City, KS residence that match the bullet casings recovered from the victim and evidence proving he was in the area at the time of the murder. However, the evidence does not pinpoint exactly whether or not Nichols was at the scene of the crime at the time. Nichols, a self-proclaimed member of the Gangster Disciples, may have taken an oath of silence to prevent law enforcement from finding out the true extent to which James McKenith, the man responsible for stabbing Burroughs, had gone. The defense also argued that Christina Love’s testimony and inconsistency in truthful statements to law enforcement was still the key to proving Nichols not guilty.
The state argued Love’s inconsistency and eventual statement of Nichols’ supposed involvement was possibly out of fear she’d be painting a target on herself for “snitching”. Love and another key witness had known Nichols for over 20 years, leading the state to believe in the possibility these individuals were reluctant to testify against him.
Deputy Coroner Dr. Altaf Hossain told the jury Thursday afternoon at the Riley County District Courthouse that the autopsy of 68-year old John Burroughs revealed eight stab wounds — including a lacerated throat, sliced lung and heart — and that they were key causes in his death. He also said a gunshot wound near the neck area also contributed.
Anthony Nichols, a 35-year old Kansas City man, is facing a first-degree murder charge in the death of Burroughs, a Manhattan man. Nichols was sentenced on June 1 in the Geary County District Court and plead no contest in April to voluntary manslaughter and aggravated robbery for the death of of 37-year old Anthony Nixon of Junction City the day after Burroughs was killed in September 2013.
Another man, 34-year old James McKenith of Manhattan, was sentenced in May 2014 to life in prison for stabbing and killing Burroughs.
In this trial, the prosecution is seeking to convict Nichols for the gunshot wound after previous testimony indicated Nichols and 51-year-old Christina Love went to check on Burroughs at his residence after McKenith — Love’s son — had stabbed him.
Love told the jury earlier in the day Thursday that after going to the door with Nichols she was instructed to return to the car. While waiting for Nichols, she said she heard a gun shot minutes later.
Defense attorney Jeffrey Wicks asked Hossain which of the injuries were the most critical and if the alleged timeline of the gunshot wound suggested the stabbing injuries proved to be the most fatal.
Hossain said the stabbing injuries to the neck and heart were the most critical and most immediately life-threatening. He said there was “a lot of blood” at the scene of Burrough’s residence and the amount of blood was greatly due to the stabbing wounds.
However he added that the timing of the gunshot — whether it was when Burroughs was visited by McKenith or by Nichols — was hard to assume.
Drugs and prostitution were also involved, according to testimony.
The prosecution and defense rested their cases and closing arguments will be at 8:45 a.m. Friday morning.
JC doctor arrested for sexual battery of a juvenile
A Junction City doctor has been arrested on an aggravated sexual battery charge.
Allan Holiday was taken into custody Thursday evening at about 5:30. According to Lt. Jeff Childs with the Junction City Police Department, Holiday was arrested after a report from this past Sunday of an alleged aggravated sexual battery of a 16-year-old juvenile.
The gender of the juvenile has not been released.
Childs indicated after an investigation, Holiday was arrested on probable cause. The incident reportedly occurred at a residence in Junction City.
Holiday is listed as an Orthopedic Surgeon at Geary Community Hospital.

JCPD warns of fake cash being used at businesses
The Junction City Police Department has received reports that subjects in the area have been attempting to pass money to local business that is not U.S. currency.
Law enforcement officials told KMAN these bills indicate that they are not U.S. currency on them and they also indicate that they are for motion picture use only. The JCPD wants to inform the citizens of Junction City to be sure to inspect any cash that they are given.
Anyone who has information about these bills being passed at businesses are urged to contact the police department at 785-762-5912.

Two death investigations in Junction City
Junction City Police are investigating two separate deaths the past few days within a block of each other.
Early Tuesday morning Officers responded to the 500 block of West Spruce Street in reference to an injured subject. Upon arrival shortly before 12:30 a.m., officers located a 22-year-old male subject with critical injuries. The subject was transported to Geary Community Hospital where he later died. An autopsy has been scheduled and the case is under investigation. At this time no foul play is suspected.
And shortly before 10:30 a.m. Monday, JCPD Officers responded to the 600 block of West Spruce Street in reference to an unresponsive subject. Upon arrival officers located a 70-year-old male deceased. While no foul play is suspected at this time the case is being investigated by detectives.
Police indicate the two cases are not related.

Senators search for answers on criminal Kansas immigrant
Senators Jerry Moran, Pat Roberts and Senate Judiciary Committee Chairman Chuck Grassley called on the Department of Homeland Security to provide answers following a criminal case involving Tomas Martinez-Maldonado. Martinez-Maldonado, a Mexico native, who was arrested months ago in Geary County on a charge of child rape.
The office of Senator Moran says that these senators have formally written a letter to Department of Homeland Security Secretary Jeh Johnson, requesting Martinez-Maldonado’s full criminal and immigration history. They inquire about why he was able to re-enter and remain in the country several times despite his unlawful status and previous felony conviction for illegal re-entry into the United States.

(October 8, 2016) JUNCTION CITY, Kan. (AP) Authorities say a man from Mexico who has been deported several times faces charges accusing him of raping a child in Kansas.
Tomas Martinez-Maldonado is jailed in Geary County on $100,000 bond on a charge of raping a child under the age of 14 last month. Public defender Cole Hawver declined to comment Friday. The public defender’s office was appointed to represent Martinez-Maldonado during his first appearance Thursday.
The Kansas Bureau of Information says he was taken into custody in late September in Missouri, where authorities alerted U.S. Immigration and Customs Enforcement.
ICE said Friday that Martinez-Maldonado has been deported back to Mexico 10 times since 2010. ICE also says he’s a priority for deportation when his Kansas case is completed.

Manhattan unemployment low
Manhattan unemployment numbers continue to be low but have gone up a little since this same time last year. November numbers just released by the Kansas Department of Labor indicate a 3.1 percent number for the Manhattan Metro area in Riley and Pottawatomie Counties, compared to 2.6 last year. The Manhattan-Junction City area is a bit higher at 3.5 percent. The Manhattan Riley County number is 2.9 percent.
Area county numbers include Riley at 2.5, Pottawatomie at 2.9, Geary at 5.3, and Clay at 3.6 percent. Junction City had a 5.1 percent unemployment rate.
Manhattan has the lowest city rate in the state at 2.3 percent and the 3.1 percent Manhattan metro number is also the lowest state-wide.

Midnight car chase leads to arrest of robbery, homicide suspects in Geary County

A man and woman who evaded police were apprehended late Tuesday night after they crashed their vehicle and fled on foot near I-70 by McDowell Creek Road.
According to a press release from the Geary County Sheriff’s Office, authorities arrested 35-year-old Joshua Garcia of Biloxi, Miss., and 31-year-old Jamieson Townsend of Blue Springs, Mo. After their arrest it was found that the two were suspects in a string of pawn shop burglaries and robberies in the state of Mississippi — as well as suspects in a triple homicide robbery of a pawn shop in Jackson, Miss.
Just before midnight Tuesday, deputies conducted a traffic stop on a Dodge Charger for no registration displayed on I-70 near mile post 311 in Geary County. Just as contact was made with the driver, the vehicle sped away westbound on I-70. The deputy gave chase and the Charger exited at mile marker 306 (McDowell Creek Road) and took Roeser Road, which is a dead end.
The Charger wrecked and was inoperable. The driver — Garcia — took off on foot while Townsend remained with the vehicle.
Deputies set up a perimeter and searched the area, as well as farmsteads and outbuildings. At 7 a.m. while searching the area around the McDowell Creek Community Center — which is roughly a mile from the scene of the crash — Garcia was found hiding in the backseat of a vehicle and was taken into custody.
No injuries have been reported as a result of the incident, though there was some property damage at scene of the crash.
The suspects are being held at the Geary County Detention Center pending further investigation.

Inmate with Geary County convictions denied parole
A Kansas Department of Corrections inmate serving time for several Geary County charges including first degree murder apparently has been passed over for parole. 44-year-old Mikel Dreiling’s next possible earliest release date is now December of 2018.
Dreiling was convicted in connection with a prominent Geary County murder case in 1994, with public comment sessions in October and possible parole this month. The KDOC website recently updated his status with the December 2018 date. He’s being held in the Hutchinson Correctional Facility.
Dreiling and his sister Dana Flynn were sentenced in early 1997 in the shooting death of Randall Sheridan. Flynn is not eligible for release until January of 2019.

USD 475 hires former RCPD public information officer as comm director
Geary County Schools USD 475 has selected Matthew Droge as its new executive director of communications, according to a press release sent from the district.
He will replace Hugh Davis, who resigned in November to be closer to family in Lincoln, Neb. Davis’ last day will be Jan. 9.

Droge had served as a law enforcement agency spokesperson for the Riley County Police Department. He comes to Geary County Schools following a career as both a police officer and leader in communications and public relations for law enforcement. School officials recognize him as an experienced strategic and crisis communicator. He plans to use these skills to assist the District with strategic planning for upcoming projects and events.
“I look forward to seeing what this award-winning district can accomplish in the future and am excited to be able to highlight the achievements of students and staff,” Droge stated. “I plan to get started by meeting district staff as well as meeting and continuing to build relationships with community groups.”
Droge has been recognized by an international community for his work in public relations for law enforcement and was recently nominated for a Harvard Innovations in American Government Award.
The district’s executive director of communications is largely responsible for overall district communication which includes media relations, web presence, social media, its text messaging system and crisis planning. Droge will serve as the official school spokesperson and work to highlight accomplishments of Geary County Schools in print, broadcast, and online formats.

JCPD aggravated battery arrest
Junction City Police Department Sergeant Brad Diel reported on Saturday morning, January 14th, at around 1AM Junction City Police Department Officers were dispatched to 1038 Grant Avenue, Veterans Motorcycle Club, in reference to a disturbance. Through the course of the investigation, it was determined that one victim sustained injuries and was transported to Salina Reginal Hospital where the subject is in critical condition.
During the investigation two suspects were identified, Todd Mahoney 38 years of age, of Grandview Plaza and Kirk Fuller 33 years of age, of Junction City. On 01-14- 2017 both Todd Mahoney and Kirk Fuller were arrested for Aggravated Battery. Both Todd Mahoney and Kirk Fuller were confined at the Geary County Detention Center on no bond pending first appearance.
